Both bills would amend of the Social Security Act to change the process requirements for the Medicare Administrative Contractors [ MCAs ] when developing Local Coverage Determination policies [LCDs].

Recently, the wound care community has seen multiple wound care related LCDs with concerning language, coverage limitations and requirements that are not consistent with current clinical practice, Guidelines or are not substantiated by the literature. These have included LCD policies for ‘ Wound Care ’ , ‘HBO’ and a new Surgical Dressing LCD.

To amend title XVIII of the Social Security Act in Order to improve the proces s whereby Medicare Administrative Contractors issue local coverage determinations under the Medicare program and for other purposes.

Introduced in House on August 1 st by Representatives Lynn Jenkins (R.
- Kan.) and Ron Kind (D - Wis.) This bill would:

Require open and public MAC meetings that are on the record;
•    Require the disclosure by MACs of the rationale for an LCD and the evidence for that decision at the beginning of the LCD process
•    Provide stakeholders with a meaningful reconsideration process for an LC D; and
•    Prohibit MACs from adopting an LCD from another jurisdiction without first conducting its own independent evaluation of the evidence.
